CHEYENNE, Wyo. – A 48-year old Cheyenne man was arrested by The Cheyenne Police Department after they say that he discharged a firearm during an argument with another person.
According to court records, William Eikenberry was read a felony charge of Aggravated Assault & Battery – Threaten with a Weapon, by Judge Denise Nau during his initial court appearance in Laramie County Circuit Court on March 5th, 2020.
Police allege that they responded to a report of a verbal disturbance with a gun involved to a residence on the 1900 block of E. 17th St, during the evening hours of December 8th, 2019.
Officers say that they made contact with Eikenberry and the alleged victim upon arriving on scene. They report that observing both individuals to be very intoxicated.
An affidavit filed in the case alleges that Eikenberry and the accuser had gotten into an argument, and Eikenberry brandished a handgun when the alleged victim refused to leave the residence.
Police reports indicate that neither party could recall what the original argument had been about.
Law enforcement says that the victim could not recall if Eikenberry had pointed the gun directly at them during the altercation.
According to court papers, Eikenberry allegedly discharged the firearm to the side of the accuser, with the bullet penetrating the wall and going into the next room over. After firing the handgun, Eikenberry reportedly told the alleged victim that he had given them a “warning shot”.
Police say that Eikenberry had put the firearm away before they arrived on scene. They report that the bullet holes they observed in the walls were consistent with the caliber of a 9mm weapon.
Eikenberry was taken into custody and transported to the Laramie County jail.
All of those cited or arrested are presumed innocent until convicted in a court of law. Charges are subject to change following official filings from the Laramie County District Attorney’s Office.
