Cheyenne Court Documents say that a Colorado man has been arrested and faces charges, from a 2019 burglary where it was alleged that firearms were taken from a locked Cheyenne home.
Mario Aron Gutierrez, age 28, was arrested on July 30, 2020 at approximately 1:30 pm, on the 1900 block of Pioneer Avenue in Cheyenne. Court records show that Gutierrez faces a felony charge of Aggravated Burglary.
Cheyenne Police say that on March 19, 2019 officers responded to a private Cheyenne apartment for a reported burglary. A resident of the home said that he had left his home earlier in the day and locked the door. But returned to find the door unlocked and slightly ajar.
An affidavit filed in the case say that the apartment door showed signs of being forcibly opened.
The resident of the home reported that a Sig Sauer P250 .40 caliber pistol and a Remington 870 12-gauge shotgun were missing from the home. Also reported missing were a plastic case for the pistol and a fabric case for the shotgun.
The resident also reported that an X Box One video game system with controllers and cables were also missing, as well as approximately $40 of loose change.
The affidavit goes on to say that investigators later met with neighbors of the apartment resident, who had heard of the burglary. After checking their own valuables, they reported finding a fabric case for a shotgun, in a storage room of the home. Both neighbors denied ownership of the case.
The neighbors said that Gutierrez had been staying with the neighbors for approximately nine days, before the guest was driven to Colorado on March 19, 2019. It was further reported that Gutierrez had been staying in a room adjacent to the storage area where the gun case was found.
Witness reports cited by police officers in the affidavit say that when Gutierrez departed for Colorado on March 19, he was carrying two pieces of luggage, including a backpack large enough to conceal the items said to have gone missing from the burglary.
A charge of Aggravated Burglary can carry a potential penalty of 5-25 years incarceration, a fine of up to $50,000 or both.
All of those cited or arrested are presumed innocent until convicted in a court of law. Charges are subject to change following official filings from the Laramie County District Attorney’s Office.
