CHEYENNE, Wyo. – A 31-year old man was arrested by the Cheyenne Police Department and now faces multiple criminal charges following allegations he attempted to elude police by driving recklessly on Del Range Blvd.
According to paperwork filed in Laramie County Circuit Court, Calvin Aubin Jr. made his initial appearance in court on January 6th, 2020 to hear the recommended felony charge of Aggravated Assault read to him by Judge Lee.
Aubin was also read misdemeanor charges of Theft, Reckless Driving, Eluding, Speeding. and Failure to Stop at a Red Light during the same court proceedings.
The affidavit of probable cause filed in the case says that police officers were dispatched to 1400 Dell Range Blvd. during the evening hours of September 2nd, 2020 to investigate a report of shoplifting.
Police were told that the suspect had fled the scene in a BMW sedan with no registration.
“I was traveling eastbound on Prairie Ave and observed the BMW driven by Calvin Aubin turn westbound onto Prairie Ave. I called a traffic stop via radio transmission and initiated by patrol vehicle lights and siren. The vehicle refused to stop and attempted to pick up speed,” the officer reported in the affidavit.
Police go on to say that Aubin drove to Dell Range and traveled eastbound while continuing to refuse to pull over.
“Aubin drove at high speeds down Dell Range and was passing vehicles. He drove at least 80 mph in a 40-mph zone,” the officer stated.
Authorities say that Aubin ran a red light during the pursuit.
“Aubin drove in the westbound lane traveling eastbound with oncoming traffic then cut off a vehicle to get back in the eastbound lane.
Investigators say that Aubin was observed stealing two pairs of Nike tennis shows via store video surveillance. The total amount stolen was said to be $145.00
According to the affidavit, law enforcement also spoke to an eyewitnesse who allege they saw Aubin shoplift several items.
“Based on the witness’ description and several prior shopliftings in the area, I believed the suspect to be Aubin,” the officer stated. Police say that Aubin is being sought in two other open shoplifting cases.
Police report that they showed a booking photo of Aubin to the witness and they identified him as the suspect who had shoplifted.
The officer reports that they attempted to contact Aubin at his residence but no one was home and his whereabouts were unknown at the time.
According to the arrest information provided by the Laramie County Court, Calvin Aubin Jr. is being charged with Aggravated Assault due to demonstrating what they describe as “extreme indifference to the value of human life” while knowingly driving 80 mph on Dell Range attempting to elude police and then crossing into oncoming traffic.
If convicted on the felony charge, Aubin could face up to 10 years in prison and/or a fine of up to $10k.
