A suspect is facing a felony charge and two misdemeanors after it was alleged that he had driven his vehicle at staff members, in the parking lot of a Cheyenne bar.
According to documents released by the Laramie County Circuit Court, the suspect is charged with Aggravated Assault, a felony. He has also been charged with misdemeanor counts of Driving While Under the Influence and Hit and Run.
All of those cited or arrested are presumed innocent until convicted in a court of law. Charges are subject to change following official filings from the Laramie County District Attorney’s Office.
Police say that a call was made to emergency dispatch at approximately 2:30 a.m. on November 14, after a suspect had threatened staff members with a knife, at a bar on the 3300 block of Nationway in Cheyenne. Reporting parties then called emergency dispatch minutes later saying that the suspect had attempted to strike employees in the parking lot of the establishment with his pickup truck.
The suspect was then accused of driving through a wooden fence and striking a tree with the vehicle, before leaving the area for a private residence.
The suspect; identified in documents as Dayne Lee McCart, born 1998; was apprehended and Cheyenne Police claim, in an affidavit, that McCart admitted to drinking earlier in the evening before going to the bar on Nationway. Police say that an administered test showed the suspect to have a blood alcohol content of .137%. Wyoming statute dictates any BAC above .08% to be legally impaired.
The suspect is scheduled for a preliminary hearing in the case later this month. Bond has been set at $10,000 cash-only.
