CHEYENNE, Wyo. — In Laramie County District Court, Jonathon Dean Alvarado, 40, was granted a deferred sentence and three years of supervised probation after pleading guilty on Aug. 1 to felony possession of cocaine in accordance with a plea agreement. The plea, accepted by Judge Catherine R. Rogers, included dismissing Alvarado’s DUI and collision-related charges, focusing on rehabilitation over punishment.
According to court documents, Officer Federer of the Cheyenne Police Department responded to an accident involving Alvarado’s yellow Jeep Wrangler on Feb. 1 at East 10th Street and Logan Avenue. Alvarado failed to yield at a stop sign, colliding with another vehicle. Upon arrival, officers observed signs of alcohol consumption, including slurred speech and unsteady balance.
Alvarado declined field sobriety tests, instead asking to be arrested. During a subsequent search, Officer Penhale located 11.8 grams of suspected cocaine in Alvarado’s jacket, according to the affidavit of probable cause.
The plea agreement specified that Alvarado, qualifying for Wyoming’s 1037 deferral program, would enter supervised probation for three years. The state dismissed the DUI and collision charges at sentencing. Alvarado received five days of jail credit and will not face further incarceration or restitution requirements.
The 1037 deferral under the Addicted Offender Act allows first-time drug offenders to avoid a conviction by successfully completing probation, supporting Alvarado’s opportunity for rehabilitation in lieu of a felony record.
