Judge Froelicher oversees probation revocations, plea changes, and sentencings in District Court proceedings

Cheyenne, Wyo. — Judge Peter H. Froelicher presided over various cases in Laramie County District Court on Dec. 26, addressing arraignments, sentencings, probation revocations and bond hearings.

Arraignments

  • Allyesha Hernandez – Hernandez pleaded not guilty during her arraignment, with trial scheduled for March 2025. A plea agreement is anticipated.
  • Justin Hofer – Hofer pleaded not guilty during his arraignment, and trial was set for March 2025.
  • William Maddox – Maddox pleaded not guilty, and his case was assigned to Judge Sharp for joinder with a co-defendant.
  • Alonso Enriquez – Enriquez pleaded not guilty during his arraignment, and trial was scheduled for March 2025.

Changes of Plea

  • Dustyn Sweat – Sweat pleaded no contest to two counts of felony theft under a plea agreement. The agreement recommended two to four years suspended for three years’ probation on each count, running concurrently, with restitution totaling $4,765. A factual basis was found, sentencing was set for March 2025 and bond was modified to own recognizance.
  • Alissa Garcia – Garcia failed to appear for her scheduled change-of-plea hearing, and a bench warrant was issued.
  • Kent Hess – Hess pleaded guilty to failure to register as a sex offender under a plea agreement recommending two to four years suspended for two years’ probation. A factual basis was found, and sentencing was scheduled for March 2025.
  • James Gulley Gulley pleaded guilty to possession of a controlled substance with a third-or-subsequent-offense enhancement under a plea agreement recommending two to five years suspended for two years’ probation, with possible inclusion in the Intensive Supervision Program. A factual basis was found, sentencing was scheduled for March 2025 and testing requirements were reduced to twice per month.
  • Corey Pounds – Pounds pleaded guilty to strangulation of a household member and domestic battery under a plea agreement. Charges of threatening with a weapon and interference with an emergency call were dismissed. The agreement recommended five to seven years suspended for three years’ probation on the strangulation charge and time served on the domestic battery charge. A factual basis was found, sentencing was set for March 2025 and testing requirements were reduced.

Probation Revocation Arraignments

  • Zain Burdine – Burdine admitted to probation violations, including absconding and acquiring a new conviction. The underlying sentence of two to four years was imposed with credit for 73 days served, and he was referred to the Intensive Treatment Unit. Public defender fees of $250 were waived.
  • Vern Tennant – Tennant denied allegations of absconding and failing to report to probation and parole. He requested referrals to the Cheyenne Addiction Center and the Intensive Supervision Program. Bond was set at $3,000 cash.

Status Conference and Bond Hearing

  • Rachel Crazy Thunder – Crazy Thunder’s status conference revealed pending presentence investigation and Addiction Severity Index reports. Sentencing was set for February 2025, and previously posted bond was returned to the poster.

Sentencings

  • Charvel Martinez – Martinez pleaded guilty to possession of a controlled substance under a plea agreement, initially considered for a § 35-7-1037 deferral but amended to a § 7-13-301 deferral. The court ordered three years’ probation with treatment, assessed $325 in court fees and waived $500 in public defender fees.
  • Edward McGaha McGaha pleaded guilty to bringing a controlled substance into a penal institution under a plea agreement recommending 18–36 months suspended for three years’ probation, with charges on counts two through five dismissed. He was ordered to undergo treatment as an addicted offender and was assessed $350 in court fees, while $500 in public defender fees were waived.
