Cheyenne man arrested on Aggravated Assault charge after allegedly pointing gun at accusers

CHEYENNE, Wyo. – Police say that a Cheyenne man was arrested during the evening hours of May 10th, 2020; after it was alleged that he pointed a handgun at two individuals outside of his residence.

According to an affidavit in the case,  Jacob McLaury was arrested by the Cheyenne Police Department and booked on a felony charge of Aggravated Assault and Battery – Threaten with Weapon.

Court documents say that the police were contacted by two people who told them that McLaury had threatened them with a firearm following a verbal dispute.

Police were told that the incident took place outside of McClaury’s residence where he is a next-door neighbor to one of the accusers.

The accusers told police that at one point during the dispute, McClaury went inside of him residence and returned with a gun. One of the accusers described the firearm as a “black and grey” firearm.

The affidavit says that the accusers then told law enforcement that McClaury proceeded to point the gun at them. One of the alleged victims told police that they thought the suspect was going to shoot them.

According to court papers, McClaury admitted to going inside of his residence to retrieve a .40 caliber Smith & Wesson SD 40 handgun but denied that he pointed it at anyone.

During his interview with authorities, McClaury said he had returned home that evening to discover a disturbance in front of his residence. He said that a group of 20-30 individuals had approached his vehicle, acting as if they wanted to start a fight.

It is alleged that McLaury told police that he came outside of his residence with a gun and racked it in front of the crowd in order to get to them to disperse.

Police say that they located a black and grey Smith & Wesson firearm inside of McClary’s residence.

All of those cited or arrested are presumed innocent until convicted in a court of law. Charges are subject to change following official filings from the Laramie County District Attorney’s Office.
