CHEYENNE, Wyo. – A 37-year old Cheyenne man was arrested by the Cheyenne Police Department on August 6th, 2020 after it was alleged that he strangled an adult and a child during the same violent altercation.
According to court documents, Cody Johnson made his initial appearance in Laramie County Circuit Court on Friday, August 7th, 2020 to be read the felony charges of Attempted Child Abuse and two counts of Strangulation of a Household Member read to him.
If convicted on all three felony counts, Johnson could face up to 30 years in prison and or a find of up to 30k.
Police say officers responded to a call of a possible domestic battery during the evening hours of August 6th, 2020. Upon arriving at the residence officers made contact with an accuser who alleged that Johnson had strangled themself and a child during an altercation earlier that evening.
Officers report observing multiple injuries to the accuser’s head and neck during their interview, according to the affidavit filed in the case.
The alleged victim told police that Johnson had thrown them to the floor and place his hands around their neck when a verbal disagreement between them became violent. Court papers say that the accuser reported to authorities that they did not lose consciousness at that time, despite the fact that Johnson had allegedly cut off their airway.
The affidavit goes on to report that the accuser was able to leave the residence and run outside. They alleged to police that Johnson followed them outside and placed them in a chokehold for approximately 10 minutes until he became “to exhausted to continue fighting”.
The accuser went on to tell law enforcement that they were to prevent themself from being choked because they held off Johnson’s arms from closing their airway.
A child who was in the residence during the alleged attack told police that Johnson had pushed them up against a wall and placed his hands on their neck.
The child advised authorities that nearly blacked out and that their eyes got fuzzy and “saw thunder” during the reported assault, according to the affidavit.
Police say that they observed signs of injury on the neck of the child.
All of those cited or arrested are presumed innocent until convicted in a court of law. Charges are subject to change following official filings from the Laramie County District Attorney’s Office.
