CHEYENNE, Wyo. – According to documents filed with the Laramie County Circuit Court Kenneth Rushing made his initial appearance in court to hear the recommended charge of Aggravated Assault read to him.
Rushing was also read a misdemeanor count of Domestic Battery read to him during the same legal proceedings.
Rushing’s appearance in court comes after he was arrested by the Cheyenne Police Department.
These charges stem from an incident last February where it is alleged that Rushing physically assaulted two people during a domestic disturbance.
Police say that officers responded to an address within the city limits during the early morning hours of February 29th, 2020 to investigate a report of an assault. Once on scene, the officers say they made contact with an accuser who alleged that Rushing had attacked them during a verbal disagreement.
The accuser told law enforcement that Rushing hit them repeatedly in the head and the face until they fell to the floor. The alleged victim went on to claim that Rushing proceeded to then kick them in the head and face while they were on the ground.
Another accuser reported to officers that when they attempted to stop Rushing from attacking the first person they were struck in the face as well.
According to the affidavit, authorities observed lacerations and other various injuries on the faces of both of the accusers.
Court documents say that Rushing fled the residence when police arrived. No information was provided on how Rushing ended up in police custody months later.
If convicted on the felony assault charge, Rushing could face up to 10 years in prison, and/or a fine of up to 10k, according to state statutes.
All of those cited or arrested are presumed innocent until convicted in a court of law. Charges are subject to change following official filings from the Laramie County District Attorney’s Office.
