Cheyenne man faces felony Assault, Child Abuse charges following arrest

CHEYENNE, Wyo. – A 40-year old man was arrested by the Cheyenne Police Department (CPD) on allegations that he forced his way into a residence and attacked two minors inside.

According to court papers, Kirk Miller made his initial appearance in Laramie County Court on January 14th, 2021 to hear the recommended charges of Criminal Trespass, Aggravated Child Abuse and Aggravated Assault and Battery read to him.

An affidavit of probable cause filed in the case reports that officers responded to a residence within the city limits of Cheyenne during the evening hours of January 13th, 2021 to investigate a report of a domestic disturbance.

Police say that when they arrived on scene they made contact with Miller who was being held down in the living room of the residence by two minors.

One of the minors told law enforcement that Miller had come by multiple times during the day to speak to an adult who was not there at the time. The minor went on to say that the last time Miller came to the residence he pushed his way through the door and into the home.

Court papers allege that Miller grabbed one of the minors by the neck and squeezed for approximately six seconds. They stated to police that they could not breathe while Miller had his hands around their neck.

The minor told authorities that Miller then slammed their head into a freezer door in the kitchen. According to the accuser, Miller began punching them in the back when they fell against a countertop.

The second minor advised police that they jumped on Miller’s back to try and stop his assault. The second minor alleged that Miller punched them in the face over his shoulder approximately three times.

The second minor reported that Miller then grabbed them by their neck and threw them over the countertop.

According to the affidavit, police observed multiple scratches, marks and injuries on the two minors.

If convicted on the felony charges of Child Abuse and Aggravated Assault, Miller could face up to 35 years in prison and/or a fine of up to $20,000.

This is the second time in the last few months that the suspect has been arrested for charges of Child Abuse. Miller was arrested by the Cheyenne Police Department on allegations that he physically assaulted a child under 18 years of age on November 15th, 2020.


All of those cited or arrested are presumed innocent until convicted in a court of law. Charges are subject to change following official filings from the Laramie County District Attorney’s Office.
